1. Agreement

These Terms of Service (the "Terms") govern your use of the smartxcore.com website (the "Site") and any software, services, or content offered by SmartCore LLC ("SmartCore", "we", "us") through this Site or its product channels, including smveo.com (the "Drive Video Site") and the Drive Video desktop application (the "Software"). By using the Site or the Software, you agree to these Terms.

2. Company information

SmartCore LLC is a limited liability company registered in the State of South Dakota, United States.

3. Permitted use of the Site

The Site is provided for general informational purposes about SmartCore LLC and its products. You agree not to misuse the Site by attempting to compromise its security, scrape it at unreasonable rates, or use it for unlawful purposes.

4. Software license

The Drive Video desktop application is proprietary software owned and licensed by SmartCore LLC. When you install Drive Video, you accept a non-exclusive, non-transferable license to use the Software for personal or internal business purposes, subject to any product-specific license terms presented during installation. You may not reverse-engineer, redistribute, or modify the Software except as permitted by applicable law.

5. Authenticity and code signing

All official releases of SmartCore software are digitally signed with an Extended Validation (EV) code-signing certificate issued to SmartCore LLC. You should only install SmartCore software obtained through the official distribution channels listed on this Site or on smveo.com. SmartCore disclaims liability for any harm arising from modified or repackaged copies of the Software obtained from unofficial sources.

6. Intellectual property

All content on the Site — including text, graphics, logos, icons, source code, and software — is the property of SmartCore LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. You may not reproduce or distribute content from the Site without prior written permission.

7. No warranties

The Site and the Software are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SmartCore does not warrant that the Site or the Software will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by applicable law, SmartCore LLC, its members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Site or the Software.

9. Indemnification

You agree to indemnify and hold harmless SmartCore LLC, its managing members, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your violation of these Terms, your use of the Site or Software, or your violation of any third-party rights.

10. Privacy

Our handling of personal information is described in the Privacy Notice. By using the Site, you acknowledge that you have read the Privacy Notice.

11. Governing law

These Terms are governed by the laws of the State of South Dakota and the federal laws of the United States, without regard to conflict-of-laws principles. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in South Dakota.
